6-year-old charged with sexual assault for consensual doctor play

Grant County authorities have accused a 6-year-old boy of first-degree sexual assault of a child for allegedly playing “doctor” with a 5-year-old girl in September.

The case, which is plowing new legal ground in Wisconsin, calls into question when a child’s act can be considered criminal — particularly when it involves behavior some experts say is normal for children that age —

Normal behavior is criminalized (Overcriminalization)

Of course, normal behavior is criminalized at all ages. Playing doctor for kids, adolescent sexuality later, sexting and photographing legal sex acts (child pornography). Or attraction of grown men to adolescent women. All is illegal.

According to the petition for protection or services filed Nov. 12, the girl’s mother found her daughter in the boy’s yard “with her skirt and underpants around her ankles” and the boy sitting underneath her, penetrating her with his finger. The petition alleges the boy “did have sexual intercourse with a child under the age of 12.”

State law defines sexual intercourse, in part, as “intrusion, however slight, of any part of a person’s body.”

Toddlers need legal counsel and classes in stupid adult sex laws

The boy failed to read Human-Stupidity.com’s advice about playing doctor. 

Typical problems:

  • Only one witness, the mother. If she has a grudge with the boy, his family, or if she is mentally instable suffering from phantasies, her accusation is accepted.
    • The daughter, after being exposed to mother’s hysteria, is not a reliable witness.
    • The boy’s confession to the mother is hearsay. He needs to be read his Miranda rights and be advised to plead the 5th (not to say anything because he could incriminate himself).
    • Furthermore the boy is not fit to stand trial
    • I know, this is ridiculous.
  • language abuse: slightest penetration with the finger is called "sexual intercourse". Why does modern feminist inspired law have to pervert our language?
  • Discrimination against males: why can’t the girl be guilty for statutory rape?
  • No Romeo and Juliet clause for being of similar age

The girl told her mother they were playing “butt doctor” and told authorities the boy only touched her on the outside of her body, court documents state. A third child, a 5-year-old boy, also was with them, but he did not touch her inappropriately, the girl said.

All hinges on mother’s statement. Maybe she is hysterical?

Judge Leineweber refused to dismiss the petitions, saying the relevant part of the sexual assault allegation is the mother’s observations.  Case asks: Can a 6-year-old commit sexual assault?

Next problem:

  • confounding consensual* acts with sexual assault. Did he hold down the girl against her will? Yes, I know, the girl is unable to consent. So is the boy.

The boy needed only to have penetrated the girl and known she was under a certain age, he wrote, adding, “Even the most immature 6-year-old could appreciate these two concepts.”

Why should a 6-year-old know that playing doctor is a felony? Did we teach him?

Why should a boy understand that playing doctor is a heinous crime?  That is about as asinine as criminalizing taking one’s own photos.

Why should 6-year-old boys know that consensual doctor play constitutes sexual assault?

He  probably does not know what sex is. But he knows what consent is and the girl certainly consented.

The most immature 6-year-old understands the concept of consent. Adults and judges don’t understand the difference between consensual*  activities and sexual assault/rape.

The boy’s lawyer, Stephen Eisenberg of Madison, called the allegations “crazy” and said he has never heard of a 6-year-old being accused of first-degree sexual assault. The boy is now 7.

Dangerous pedophile vigilantes who cheer German Dad, 47, for castrating the boyfriend, 57, of his 17-year-old daughter certainly would violently object such an age difference as indecent, immoral and borderline pedophile . Marcela clearly is a “victim”, in need of judicial help.

After all, when they married, she was 20, he 63.  He could easily be her grandfather.  If she were 3 years younger (17) and he were 40 years younger (23), in the USA, the land of the free, this would be  considered pedophilia, worth of a decade in jail. Even if they had no sexual relationship, he could face criminal  charges for grooming her.  And notice, in the case of the german dad who castrated the boyfriend of his daughter, there is no mention of sexual relationship.

    Age of consent laws are designed to punish beta males. A beta male in his 20s, unsuccessful with women his own age who are infused with a sense of feminist entitlement and deride all but the top alpha males who take interest in them, who seeks companionship with a younger, sexually mature female who desires him, should not go to prison for acting on that which is normal male sexuality. A society that criminalizes this is a society that values females over males and treats women as if they are children.

    If we are to treat women as children then we should be consistent. Young women who have sex with older men are as much victims as women who have sex with a pick-up artist after meeting at a club. In both cases, feminists are angry because the woman has been “fooled” into having sex with a less than ideal mate in terms of value. In the first case, the male appears to be of higher value than he really is because he is older and more experienced. In the second case, the male appears to be of higher value than he really is because he has learned the elements of attraction. In both cases, women are presumed (by feminists) to have no responsibility for their own actions and to be little more than children, than animals who are guided only by instinct.

    Sex laws traumatize 14 year old school boy who was happy to have affair with 26 year old woman

    A mother-of-two caught naked in bed with a 14-year-old schoolboy who bragged about the affair on Facebook has been jailed.  Susanne Divers, 26, befriended the boy after meeting him at a party and later began an affair that lasted more than a month.     It is pretty clear how this 14 year old boy was damaged by the woman predator. So much that he bragged all over, and wanted to commit suicide when she tried to break up. The repressive teenage sex laws were to blame for the breakup attempts. So the laws actually are detrimental to teenagers.

    Over 200 comments to the above article agree mainly that the law is wrong. Most commenters would not have the courage to say that the law is also wrong if the “victim” were female happily agreeing and consenting to a relationship with an older guy.

    If society were not so totally convinced by the dogma of gender equality, then it would even be worth analyzing if there should be different measures for both sexes. Some fathers might actually be proud if their 14 year old son had an affair with a 26 year old woman, but most parents would be much more concerned if their 14 year old daughter had an affair with a 26 year old man. Maybe human instinct is a better guide then equality laws.

    Why is everyone calling this guy a perv?? He was DATING the girl, not raping her! If an 18 year old guy was dating her, would you call him a “perv”?? Remember, Charile Chaplin married his wife when he was 54 and she was 17, and they had 8 kids together and stayed married for 30 years until his death, and she never remarried and is now buried next to him.     Why? A 17 year old has zero emotional maturity; won’t for about 10 more years. There is no way on the face of this earth that man isn’t out for totally fresh tail. Do that to my baby, pray that I only castrate you. We’ve taught her well, but someone who is determined sometimes succeeds. There’s no way that relationship is ok. No way. At 17, you are still legally responsible. I called my husband to tell him about this. This is what he said: “You help me, then cut yourself a plea deal and testify against me” We love our daughter, end of story. It is not ok at 17. It is not ok under 25. Period.

    Child porn laws and underage sex laws have caused inumerous deaths and suffering.

    It is amazing that judge Weinstein has not been arrested, deposed, assassinated yet. He really goes against the grain of the entire child porn witch hunt.

    Get a lawyer before sex: 27 precautions before risking sex with a woman

    A man who dares to have sex with a woman needs legal counsel. He is guilty until proven innocent on many charges, which can be filed years after sex. A woman can claim she withdrew consent in the middle of the act, was unable to consent because she was drunk, drugged, had mental problems; she can look older, lie about her age and have fake id; can insert sperm from a condom into her vagina to inseminate herself, can get child support even if SHE raped him; injure herself and accuse him of battery and rape. He may go to jail for doing a DNA test on the cuckold child from his wive’s adulterous affair. Even sex dolls can look underage, and masturbation has its risks.

    Nowadays, a man cannot simply engage in sex. He might get arrested, jailed for decades, registered as a sex offender, or have to pay spousal support and child support for a few dacades.

    A mere 27 precautions can help to significantly diminish these dangers, but can not eliminate them

    Precautions in order to safely (?) engage in sex with a woman

    Legal precautions before engaging in sex in Brazil

    The following text has been made popular in Brazilian blogs. It proposes a list of all the precautions a man has to go through before risking to engage in sex with a woman. Other countries are usually even more stringent and have even more dangers, as I will show

    Then I will show that the author has been very optimistic and his precautions are way insufficient.

    First take the girl to a hospital emergency room and request a blood test for alcohol and other drugs, to avoid charges of sexual contact through fraud with a person unable to consent or resist.(Art. 215 CPB) Then go with her to a notary public and require her to file a declaration that you are practicing consensual sex, to avoid charges of rape. (Art. 213 CPB) Also, demand that she register a declaration with the notary republic that she is engaging in casual sex, to avoid any claim for breach of a stable common law relationship with her partner. (Law 9.278, Art. 7) Next, go to a laboratory and require an examination of beta-HCG (human chorionic gonadotrophin) to make sure that you are not the guy chosen to support it her in a pre-existing pregnancy with a baby that is not yours. (Law 11.804 Art. 6)
    At the motel or at home, use condoms and don’t even think of “rough sex” to avoid accusations of domestic violence and get thrown in jail for spousal abuse ( Law Nº 11.340). Also, you should pamper her, praise her, never criticize her or complain about anything, (you must be the perfect mate), so as not to cause any “physical, sexual or psychological suffering and moral damage.” You of course are without any of the same rights in return. (Law 11.340 Art. 5) Upon leaving the motel, take her to the Forensic Medicine Institute and require a medical examination, be sure to request an expedited report for the possibility of bodily injury (Art. 129 CPB) and to check for the presence of sperm in the vagina, to TRY to avoid spending nine months of hell if she later becomes pregnant by another guy (Law 11.804 Art. 6).  Finally, if the presence of sperm in the vagina of the girl is detected, immediately require a collection of samples for further investigation of paternity ((??Law1.060 Section 3 paragraph VI) and request a refund of any alimony obtained through deception or fraud. (Art. 171 CPB)

    Having done all this, MAYBE you can practice “safe sex” if you are still interested.

    This list is a good start, but unfortunately quite incomplete and left out a lot of risk factors, such as

    • underage statutory rape charges
    • fake ID
    • rape charges due to withdrawal of consent in the midst of the sex act
    • jurisdictional problems during travel
    • prostitution charges (which soon might elevate age of consent to 21 years)

    I attempt to remedy these omissions and elaborate a more complete list of measures

    A) Get Legal Counsel to understand the local law

    you thought you could have sex without a lawyer? No way!


    The girl looks quite clearly underage. Thus ID check, verification for fake ID, study of federal and state law regarding their age differences for application of Romeo & Juliet laws would be of major importance. Also informed consent about the risks, for example that the girl might withdraw consent at any time, a right which probably cannot be signed away in a contract. A lawyer should also advise his client that no photos must be taken, to avoid sexting child porn charges. So the video, though interesting, is very very incomplete.
