Token "ghost" candidates fill women’s 30% quotas in Brazil’s municipal elections

In Brazil, political campaigns are in full swing for the upcoming municipal elections. Stupid laws, inspired by political correctness and feminism require parties to have at least 30 % female candidates. 1 2 3 4

‘Brazilians typical knack for circumventing laws found a brilliant solution to the dearth of females with qualifications and desire to run for office , They convince token women to pose as fake ghost-candidates. These fake female candidates pave the way so that male candidates that actually want to run for office are allowed to do so.

These are the first elections where the mandatory 30% quota for women has been reached, with 30.74% of the candidates being women, compared to 21.37% in 2008.

Miraculously, women got more interested in becoming candidates. Or the patriarchy has stopped repressing women’s ambition towards political positions and thus women become liberated

But the numbers, that on one side are showing a change in the political climate of the country, might, in reality, be a strategy to bypass the law: "the use of fake women candidates: women who become candidates simply to fulfill the quotas.

The judge Murilo Kieling, responsible for the registration of candidates in Rio de Janeiro, confirms that the use of "fakes" might be a crime only if the person does not know that she is a candidate.

Frequently these women become candidates in reply to a political party’s request. They don’t even campaign. But a party that indicates a ‘ghost" candidate, a party member that is not even aware of her being a candidate, that party would be committing a crime.

In order to fulfill the 30% quota requirement, parties find "ghost" candidates, women that even don’t know they are candidates. Or at least women who know they are candidates but do not campaign.

Among the 18 candidates that got less then 40 votes in the 2010 state elections,17 were women.  3

These candidates don’t care about political posts, and nobody votes for them.

14 year old murdered 8, will kill 3 more when freed in 45 days. Liberal child protection law run amok in Brazil.

Brazil‘s ECA (Statute of children and adolescents law is an example for well meant liberal political correctness run amok. No matter how many horrendous crimes an under 18 year old commits, s/he will only be sent for educational measures of maximum 3 years, and will receive a clean police record after age 18.

The teenager accused of double murder in Marazion, was arrested provisionally and will be held for 45 days. After that date, if the process is not judged in a timely manner, he will be released.  Teen killer 

It is absolutely impossible to get a verdict in 45 days. The police inquiry alone takes longer. He already has accusations for other murders that still are in the phase of police inquiry. 

Now if he were judged and convicted, the most he could get is: 3 years of educational measures and his criminal past wiped clean after age 18 (or 2?).

Liberal political correctness is a crime against honest law abiding people. Imagine you contract a 21 year old after getting a clean police background check. But in reality he has killed half a dozen people, but his record has been wiped clean, as required by law!

Daughter awarded US$ 110,000 for father’s emotional neglect- Brazilian Supreme Court

The Brazilian Supreme court awarded US$ 110,000 of moral damages to a daughter who felt emotionally abandoned and felt treated as second class daughter by her father. The court dismissed the father’s defense that this emotional abandonment was caused by the mother’s aggressive behavior. Also the fact that paternity of the now adult daughter was only officially established recently.

Such legal liability is now in the process of being incorporated into the ECA statute of adolescent and children’s rights.

The intent of giving emotional support is noble. Human-Stupidity deplores the overcriminalization and total regulamentation of all aspects of human behavior under the threat of heavy civil liabilities.

Due to the importance of such decisions to Libertarians,  the men’s rights (and feminist) movement, we translated two newspaper articles in their entirety.

SAO PAULO – The Third Chamber of the Superior Court of Justice (STJ) ordered a father to pay R $ 200 thousand [US$ 110 000] to his daughter for "emotional distance". The decision is unprecedented. In 2005, the Fourth Chamber of the Supreme Court had rejected moral damages for emotional distance.

The case judged originates from São Paulo. The author of the case obtained judicial recognition of paternity and filed suit against the father because he had suffered material and emotional neglect during childhood and adolescence. The trial judge dismissed the petition and attributed the father’s distance to "aggressive behavior" of her mother towards the father. The woman appealed to the appeals court and said the father was "wealthy and prosperous." The Court of São Paulo (TJSP) reversed the judgment and set the compensation for R$ 415,000.

On appeal to the Supreme Court, the father argued that there was no abandonment, and even if he had done so, there would be illegal to be financially indemnified and the only possible punishment for failing with such obligations fathers would be the loss of family power.

Minister Nancy Andrighi , the of the court’s third chamber, however, understood that it is possible to demand compensation for moral damage caused by emotional abandonment by parents. "Love is optional, care is duty," she said in the sentence. For her, there is no reason to treat the damage to family relationships differently from other civil damages.

Racist joke by stand up comedian: theater owner arrested in Brazil

Police were called, the justice secretary office of the state of São Paulo opened an inquiry into the crime of racism against a stand up comedian. 1 One owner of the nightclub was arrested and released on bail. The night club might get closed down. Sanitary authorities were called and the night club’s kitchen was closed. An alien kitchen worker was sent home to get his documentation.

The crime: a racist joke

The crime? Black comedian Felipe Hamachi had called a black musician "monkey".  At a comedy show where all guests had signed a waiver, that they are aware that they can be the target of offensive humor and jokes. The musician was not a paying guest and had not signed the waiver. Rather he worked in the show, but had mingled with the paying public. Legal officials stated that the waiver was legally invalid, as nobody can sign away their human rights. A comedian that can not make jukes without offending a large portion of the  population should change his profession.

All humor has a "victim". Prohibiting jokes about blacks while those about Portuguese, blondes, Japanese and several other groups are allowed, it is more racist than the offensive joke itself.

Brazilian congress plans heavy fines to companies whenever a woman gets paid less then a man

Even in countries with Latin machismo like Brazil, feminism is almost unopposedly changing laws to unjustly benefit women at the detriment of men. They even have slut walks in Brazil on 4th of July in São Paulo.

The Brazilian congress is examining the bill 6.393/2009. If passed into law, companies will be fined retroactively every time a woman earning less than a man. The fine is five times the pay difference observed throughout the entire employment period.
The retroactive effect is one of the absurdities that inhabit that bill. Another is the direction of the fine to the affected employee. [...]And the men? What will they say this measure? What can they do if your salary is lower than that of a woman?

This is the opinion of a reasonable blogger, published in today’s newspaper "O Globo". . He worries that companies lose discretion to reward performance and differentiate pay. Probably, he thinks, the result will be that nobody gets a raise, everyone gets the base salary for his profession. So nobody can feel discriminated against.

Recognition

According to president of ALEAM State Representative Richard Nicholas (PSD), the public hearing is extremely important, because in addition to recognizing the importance of women in the labor market, since they already occupy  various management positions, it shows that progress is needed. Ricardo Nicholas points out that there are data showing that women in the same work as men still receive a lower salary. "It is necessary to fight this," emphasizes Nicholas.
The President of the Legislative adds that women have distinguished themselves not only the sensitivity but also for their skill, dedication and discipline. And he recalled that the woman has more than one work shift. "She has the business and also works part to take care of family, children, home. Our tribute is for women to be placed increasingly on the labor market, with the certainty of having the same rights, "he said.

 

  1. Example how to calculate the fine: suppose the man earns $ 3300, the woman earns $ 3000 monthly. For 5 years of work, the difference would be 5 * 12 * $ 300 multiplied by 5 for the fine:  $ 90 000.

DILMA-E-LULA-MARCAIn divorce, separation, or dissolution of a common law marriage, the woman will be the one to retain property of the house or apartment acquired with a government funded program "My House, My Life"  that gives millions of low income citizens their first and only real estate property.

She did not determine how to discriminate in same sex Gay and Lesbian stable relationships, which are legal in Brazil.

President Dilma Rousseff will announce later, on public television, changes in the program "My house, my life" that will benefit women

The name "My house, my life" shows the extreme importance of a first hard earned house. And this  will automatically go to the woman! Even in the case of a simple "stable relationship" with no marriage, no children. Even if there is a pre-nup contract determining separation of property. Even if the relationship was short, even if the man exclusively paid for the house. There goes his dream in the name of equality for women

In the case of separation, divorce, or undoing of a stable long term relationship, the ownership title of the real estate acquired through "My House, My Life" will be given to the women, or transferred to her regardless of the marital property regime.

The new rule applies to families with income range of up to three minimum wages that hat 95% of the value of the property financed by the program. [...]

In cases where child custody is assigned exclusively to the husband or male partner,  the title of ownership of the property will be registered in his name.

Brazil votes to criminalize homophobia. Political correctness threatens freedom of expression & research

The Brazilian congress is about to vote the criminalization of homophobia.("O Globo" newspaper Friday May 13th).  Religious parties and churches oppose the law, because priests preaching against homosexuality would face arrest for the crime of homophobia. The proposed law was amended to exempt priests preaching while inside churches. In other words, anyone outside a church can not voice any negative opinion about homosexuality.

Brazil already has anti-discrimination laws favoring gays (in addition laws against racism, religious discrimination, etc.).  Business owners, or building managers, who disallowed public display gay deep French kissing face arrest and fines, except if they could prove they also had a history of disallowing heterosexual kissing. Hotels must not discriminate against gay couples. This law would further strengthen existing anti-discrimination laws and impose stiff jail sentences.

This attempt at passing laws criminalizing homophobia comes right after the Brazilian Supreme Court, in a rare unanimous vote, decided to take lawmaking it its own hand and declared that homosexual couples have the same rights as heterosexual couples on all issues.  For example, inheritance, joint tax declarations, joint health insurance, common law marriage, right to property acquired during cohabitation, etc. Some minor doubts remain if this includes the right for gay couples to adopt children.

No free speech, nor free academic research

Historically, for anti-discrimination laws, even science is not a valid  excuse: the book "The Bell Curve" was prohibited in Brazil because of the crime of racism, due to long existing laws against racism. The US is not much better, then president Clinton condemned the book, admittedly without having read it. But in the US nobody will be arrested and jailed for research on racial differences (they will just be harassed).

It is interesting to note that Brazil’s and Rio’s officials fought to win the title "best gay destination in the world" but are vigorously opposed to "sexual tourism", meaning heterosexual males in search of sex with Brazilian women.

The slippery slope from protecting against violence to policing words, thoughts and research

Political correctness started as a well meant attempt to correct legitimate grievances, like violence against homosexuals or other races (especially Blacks) and religion (especially Muslim), and gender discrimination (harassment). The next step, still defensible, punishes hate speech meant to directly and immediately incite violence.

So the initial intent was to outlaw "Kill blacks", "exterminate Jews", "beat faggots" speech. But that soon led to stifling thoughts and speech that hurts the sensitive of protected minorities.

It is a serious restriction to freedom of speech, freedom of thought, freedom of research to extend these anti-violence codes to

  • people who tell their kids not to become homosexual or
  • scholarly researcher’s writings about racial differences in IQ and criminality.
  • people who warn to avoid parts of town because they are more dangerous (and predominantly black)

Homophobic jokes, Racist speech, racist jokes, can get people arrested and jailed.

Almost everything that can be said is offensive to some protected group, or actually constitutes a crime: our society suffers from overcriminalization.

Public speech, commercial advertising, is very difficult, because it is easy to offend some group, be it Blacks, Indians, women, obese, handicapped, nurses, any group whatsoever. Maybe with the exception of white males that can be bashed at will for allegedly not pertaining to a protected disadvantaged minority.

Human-Stupidity Analysis

Dangerous pedophile vigilantes who cheer German Dad, 47, for castrating the boyfriend, 57, of his 17-year-old daughter certainly would violently object such an age difference as indecent, immoral and borderline pedophile . Marcela clearly is a “victim”, in need of judicial help.

After all, when they married, she was 20, he 63.  He could easily be her grandfather.  If she were 3 years younger (17) and he were 40 years younger (23), in the USA, the land of the free, this would be  considered pedophilia, worth of a decade in jail. Even if they had no sexual relationship, he could face criminal  charges for grooming her.  And notice, in the case of the german dad who castrated the boyfriend of his daughter, there is no mention of sexual relationship.

In Brazil, nobody thinks that the young wife of a much older extremely successful politician is a victim. Certainly many young women would love to be in her place. Maybe something is wrong with our sexually-obsessed religious morality.
